A July hearing to determine the amount of losses incurred by four publicans, who won test actions over FBD’s failure to pay out on business disruption claims caused by Covid-19, must finish within the allotted two weeks, a High Court judge has said.
Mr Justice McDonald said on Wednesday it would not be possible to extend the hearing into August, due to a lack of judicial resources,
He also criticised “unhelpful” and “counterproductive” correspondence concerning legal costs issues between solicitors for two of the publicans in the case, Aberken and Hyper Trust, and FBD.
The Central Bank expects insurance company FBD to pay all âreasonable costsâ of publicans who successfully challenged the insurance company over failure to compensate them for Covid-19 business disruption.
The regulatorâs position was set out in a letter read to the Commercial Court on Friday.
The court previously ruled the costs should be awarded in the normal way, but said this was subject to any position taken by the Central Bank. The previous ruling would have meant the pubs would be likely to receive the minimum reasonable amount they required to fight the case but would not necessarily be reimbursed for all the costs they incurred.
