HELENA â A unanimous Montana Supreme Court Tuesday rejected legislative Republicansâ attempt to dismiss a case that could define lawmakersâ power to obtain internal court documents, saying itâs still a case of âgreat public interest.â
âThe matter at hand is one of serious public interest, is likely to reoccur and is in need of a ruling to guide public officers in the performance of their duties,â Chief Justice Mike McGrath wrote for the court.

HELENA â Republicans at the Montana Legislature are withdrawing their request for internal communication documents from the state Supreme Court, attempting to end legal action over the issue, state Sen. Greg Hertz of Polson said Tuesday.
In a statement, Hertz said withdrawing subpoenas issued by the Legislature in April are the best way to advance a special committeeâs investigation of potential conflicts of interest within the judiciary.
âThe Legislatureâs position all along has been that litigation in front of judges with inherent conflicts of interest is not the appropriate way to resolve these issues,â said Hertz, a Republican.
