In March the CAO ruled that their appeal against the High Court s decision not to grant them leave to bring their action should be dismissed on the basis it was misconceived and entirely without merit. In a ruling on Friday the three-judge court, comprised of the COA s President Mr Justice George Brimingham Mr Justice John Edwards and Ms Justice Caroline Costello found that normal rule whereby the losing side should pay the legal costs should be applied.

The action has been brought by LDB Developments Limited, which sought planning permission for a proposed three to six storey residential development at a site at Braemor Road, Churchtown, Dublin 14. Last February, An Bord Pleanala, upheld a decision previously made by Dun Laoghaire Rathdown Co Council and refused the developer s application for planning permission. Planning for the proposed project was refused by the board on the grounds that it was premature, and there were deficiencies in the developer s proposals to manage surface water on the site.

The action has been brought by 77-year-old John Barrow, who in 2017 was given a six-year prison sentence, with the final two years suspended, by the Circuit Criminal Court after he was found guilty of sexually assaulting a teenage boy. The assaults occurred on dates between 1989 and 1990, after Barrow had befriended the boy by offering him free flying lessons.
