HC lacks jurisdiction to hear govt officials service matters: SC

July 14, 2021 ISLAMABAD: The Supreme Court (SC) has held that the high court has no jurisdiction to entertain any proceedings in respect of terms and conditions of service of a civil servant, which can be adjudicated upon by a tribunal under the Act. A two-member SC bench comprising Justice Sajjad Ali Shah and Justice Syed Mansoor Ali Shah set aside an order, passed by the Lahore High Court (LHC) on February 19, 2020, directing the Services and General Administration Department (S&GAD), Government of the Punjab, to grant proforma promotion to one Shamim Usman to grade 20. The Punjab chief secretary had challenged the LHC order on the ground that the high court had no jurisdiction to entertain the said matter in the light of the constitutional bar contained in Article 212 of the Constitution.

Photo courtesy Facebook/File LAHORE: The Supreme Court on Monday disposed of as withdrawn a petition challenging the detention of Hafiz Saad Rizvi, chief of proscribed Tehreek-i-Labbaik Pakistan (TLP). As a two-judge bench headed by Justice Sajjad Ali Shah took up the petition at the Lahore registry, Rizvi’s counsel Burhan Moazzam Malik said a review board had set aside the previous detention of Rizvi. However, he said, the government on July 10 issued a fresh notification extending the detention of the TLP chief for further 90 days. Justice Shah observed that the review board had already set aside the detention assailed in the instant petition.

LAHORE: The Supreme Court on Friday suspended a show-cause notice issued to Saddar SP Operations Sardar Hafeezur Rehman Bugti by the Lahore High Court (LHC) for giving a misstatement in a matter related to police occupation on a citizen’s property. Earlier, the LHC registrar office presented a complete record of the proceedings against the police officer. The SC bench, comprising Justice Sajjad Ali Shah and Justice Syed Mansoor Ali Shah, suspended the show cause and proceedings against Bugti. The bench issued notice to the petitioner against the police officer for a hearing to be fixed later. SP Bugti, through his counsel, contended that he did not make any misstatement before the LHC. He said the LHC had been misled through wrong facts against him. He asked the SC to set aside the proceedings against him before the LHC.
