New York State Clamps Down on Nursing Home Revenue | Farrell Fritz, P C

To embed, copy and paste the code into your website or blog: In recent months, there has been a lot of attention on decisions made during the height of the COVID-19 pandemic in New York State in regard to nursing homes.  Some of that attention has focused on an order issued in the early days of the pandemic requiring nursing homes to readmit COVID-positive residents previously referred to hospitals, at a time when one of the State’s primary concerns was potential hospital overcrowding.  Even more attention has been paid to the fallout from that order, including not only the consequent outbreaks in impacted nursing homes and resulting deaths, but also on whether or not regulators attempted to hide that information and its potential linkage to the readmission order.

Senate Approves LaSata Nursing Home Bill

Legislation from state Senator Kim LaSata designed to make nursing homes safer has been approved by the Michigan Senate. LaSata tells WSJM News Senate Bill 213 would allow the state’s Long Term Care Ombudsman to inspect a long-term care facility regardless of visitor restrictions. The ombudsman would be allowed in if visitor restrictions last longer than seven days, and for restrictions shorter than seven days, the facility would have to make a good faith effort at a virtual visit. LaSata says the pandemic prevented the ombudsman from entering nursing facilities. “We need them to be able to continue to go in and protect our loved ones,” LaSata said.
