Amy Pearl / Gothamist A State Supreme Court Judge ruled this week that a lawsuit filed against the MTA on behalf of a coalition of accessibility rights advocates does, in fact, represent a class of more than 500,000 people who claim they’ve been excluded from the subway system because of a lack of accessibility. The 2017 lawsuit claims that because only 20% of the subway system has elevators, the MTA is in violation of the Americans with Disability Act and the New York City Human Rights Law. 

Judge denies Buffalo teachers union injunction to stop in-person learning at schools

A State Supreme Court Judge has denied the Buffalo Teachers Federation union a preliminary injunction that sought to return to remote learning for Buffalo Public Schools. Some children in the district returned to in-person learning on February 1, despite the objection of the teachers union. The union wanted to keep schools closed to in-person learning. The Buffalo Teachers Federation leadership has said it believes schools are not clean or safe enough.

Another Update in the 22nd Congressional Vote Review

nd Congressional District in New York will be reviewed. A State Supreme Court Judge this week ordered the Oneida Board of Elections to re-canvass all 1,797 affidavit ballots after it was found the officials failed to process the registrations of dozens of voters who signed up before the deadline through the Department of Motor Vehicles. The Washington Post via Getty Images Justice Scott DelConte decided January 21 that all the affidavit ballots that had been rejected by elections officials should be reviewed. The campaign for incumbent Democrat Anthony Brindisi had called into question the rejection of close to 70 ballots from voters registered through the DMV that had not been processed on time.
