A district court judge on Wednesday denied a request from St. Peterâs Health to delay a lawsuit filed against the hospital by an oncologist who was fired late last year.Â
St. Peter s had previously asked the court to delay the lawsuit until Dr. Thomas Weiner had exhausted the in-house remedies detailed in the hospital s bylaws before turning to the courts. The judge said the administrative process would not adequately address the claims being made.
âNone of his present claims are subject to the administrative process to which Defendants expect,â Montana First Judicial District Court Judge Michael Menahan wrote.
Weiner sued the hospital Dec. 10, claiming wrongful termination. The lawsuit, as amended, includes a request for an injunction and a request to prohibit St. Peter s from filing an Adverse Action Report to the National Practitioner Data Bank or Montana Board of Medical Examiners. Class Action Calls Costco Car Battery Warranty Deceptive
Law360 (May 7, 2021, 9:51 PM EDT) Costco was hit with a proposed class action on Friday by a Florida man who claims the retail giant deceived consumers by advertising a free replacement warranty on Interstate-brand car batteries but then simply refunded their purchase price and required them to pay the current often higher price for a new one when seeking to replace a faulty item.
Plaintiff John Skandrel brought claims for breach of warranty, breach of the implied covenant of good faith and fair dealing, fraudulent concealment, unjust enrichment and violation of the Florida Deceptive and Unfair Trade Practices Act against the Washington state-based Costco.

Now, the ultimatum has led to a class action lawsuit against UWM.
A federal jury found Paul Berkins Moise guilty April 30 of 14 counts of filing false returns on behalf of unknowing clients and three counts of filing false tax returns on behalf of himself.
Moise faces a maximum penalty of three years in federal prison for each count. The government also will seek restitution for the tax losses arising out of the fraud, according to a news release from the Department of Justice.
His sentencing hearing is scheduled Aug. 9.
According to testimony, evidence presented at trial and state records, Moise owned and operated Asset Management Group Inc. at 435 Clark Road in Jacksonville.
