The racist remark was directed at Andre Gooden while he was “peacocking” with other man at the Casbah nightclub in April 2019, Swindon Crown Court heard. Gooden, 34, punched the man in face – breaking his jaw. Later interviewed by detectives, he told them: “F racist s trying to get me arrested. But I’m going to f him up, p .” Sentencing him to 12 months’ imprisonment suspended for 18 months, Judge Peter Crabtree acknowledged the man had been provoked but added: “You simply cannot take the law into your own hands in that way.”
