The notice of intent to sue from the Center for Biological Diversity, Sierra Club, Natural Resources Defense Council and others targets 16 so-called nationwide permits that allow discharges from oil and gas development, pipeline and transmission-line construction, and coal mining into waterways. “The Trump administration flagrantly violated bedrock environmental laws when it reissued the Nationwide Permits, without regard for the people, places or wildlife that are affected by this deeply flawed program,” Jared Margolis, a senior attorney at the Center for Biological Diversity, said in a release.

Yesterday was also an important day for Mother Nature and the nation. The US Court of Appeals for the District of Columbia Circuit unanimously tossed the Trump administration s replacement for Obama s Clean Power Plan (CPP) back to EPA. The Agency will now be coming out with some version of the CPP.  Look for my continuing comments on these and other Biden administration efforts to put the nation s economy on a low-carbon trajectory. Our prior alert discussed the revisions to NWP 48 and the proposed NWPs 55 and 56: U.S. Army Corps Proposes New Nationwide Permits for Seaweed and Finfish Aquaculture in Coastal Waters and Updated the Existing Nationwide Permit for Shellfish Aquaculture. After responding to comments, the USACE issued the final NWPs, which are very similar to the draft NWPs, with some minor modifications.
