PRAYAGRAJ: The Allahabad High Court has held that a minor girl enticed out of guardianship of her legal guardian cannot be allowed to stay with her husband.
The court, however, said once the girl attains the age of majority, she can acknowledge the marriage or claim it to be void, and can live with anyone of her choice.
Hearing a petition filed by the girl’s father Pradeep Tomar and another challenging the order of judicial magistrate-I, Hapur, passed on November, 24, 2020 permitting the girl to go with her husband, Justice JJ Munir observed, “It would, therefore, be open to the girl to acknowledge the marriage or claim it to be void, once she attains the age of majority. It would also be open to her, once she attains the age of majority, to go wherever she likes and stay with whomsoever she wants”.
