Family Law Week: Financial Remedy Update – February 2021

The Court of Appeal gave judgment following the Wife s appeal against an order of HHJ Oliver. The parties had married in 2009 and separated in 2019. The Wife subsequently commenced divorce and financial remedy proceedings in April 2019. The Wife applied for maintenance pending suit. The application was heard by a deputy district judge in October 2019 and the Husband was ordered to pay MPS of £2,200 pcm. The Husband appealed that order. HHJ Oliver allowed the appeal, finding that the DDJ had not carried out a critical analysis of the Wife s needs, school fees had been included in the order and there had been an assumed reduction in the mortgage instalments of £600 pcm. Whilst the judge was sure the Wife needed maintenance he did not consider he was in a position to decide what order should be made in place of the DDJ s order. The Wife appealed.

Death prompts safety work on Colchester railway footbridge | East Anglian Daily Times

Luiz Anjos died on the railway line near Colchester station - Credit: Archant Enhanced safety measures are being planned for a railway footbridge in response to a coroner s concerns following the death of a 21-year-old man near Colchester station. Luiz Anjos was found dead on the tracks under St Dominic Road footbridge on the morning of November 7 last year. A post mortem examination recorded the preliminary cause of death as multiple traumatic injuries. A subsequent inquest by senior coroner Caroline Beasley-Murray concluded that Mr Anjos had taken his own life while suffering from a diagnosed mental illness.  Mrs Beasley-Murray said that evidence revealed during the inquest had given rise to concerns.

12 month sentence on committal application for falsifying a court order upheld This is an appeal from an order committing Dahlia Griffith ( the Appellant ) to prison for 12 months for contempt of court. The background is set out in the judgment of MacDonald J ( the Judge ) [2020] EWCOP 46.  The Appellant is a relative of P, who is in a specialist hospital with a permanent disorder of consciousness.  There were proceedings in the Court of Protection concerning P s best interests. In those proceedings P was represented by the Official Solicitor. During those proceedings, an issue arose regarding disclosure of P s medical records.  The court made 3rd party orders for disclosure of P s medical records to the OS.  The Appellant also made 2 applications for disclosure to her of P s full medical file which were refused.
