USITC joins ongoing Ericsson v Samsung dispute

The US International Trade Commission (USITC) has launched an investigation into Samsung regarding alleged infringements of Swedish company Ericsson’s wireless technology patents.
Ericsson’s complaint filed with the USITC seeks a limited exclusion order and cease and desist order targeting the South Korea-based Samsung, if it is found to have been importing and selling products infringing on Ericsson patents in the US. The notice was filed on February 2.
The patents involved are US numbers 7,151,430, 6,879,849, 7,286,823 and 9,313,178. The ‘430, ‘849 and ‘178 patents reference encryption and mobile communications technologies patented by Ericsson in 2004, 2002 and 2012 respectively.
Iancu: a âgood shepherdâ of the IP system

Andrei Iancu’s departure last week marked the end of a turbulent three year-tenure at the US Trademark and Patent Office.
In his farewell address at a US Chamber of Commerce event, Iancu outlined his achievements, declaring that his tenure had delivered a “pro-innovation” culture.
“I said that we must reclaim our nation’s IP leadership and, to do so, we must focus on two high-level issues: first, creating a new, pro-innovation, pro-IP dialogue. And, second, balancing our systems and increasing the reliability of the patent grant. This is precisely what we have done,” he said.
Should Iancuâs successor take a softer tone on China?

The legal sector has been mulling the legacy of Andrei Iancu as he confirmed this week that his three-year term as head of the worldâs biggest national IP office had come to an end.
Lawyers have told
WIPR that his successor will need to look outwards in order to maintain global US leadership in IP, at a time when Chinese firms and courts are pushing for greater influence in global technology standards.
His term was dominated by escalating tensions between China and the Trump administration. Iancu used his resignation speech this week to call for an end to “state-sponsored theft”, an accusation that has been repeatedly levelled against Beijing by Trump’s officials.
