Fulford LJ, McGowan and Griffiths JJ 21 April 2021   Sentence – Sexual offences – Correct approach when sentencing for certain sexual offences against children where no actual sexual activity occurred The defendant, R, was charged with two offences of attempting to cause a fictional 13-year-old child to engage in sexual activity (s 10) (the maximum sentence was 14 years’ imprisonment). He was sentenced to two years’ imprisonment. The Registrar of Criminal Appeals referred R’s application for leave to appeal to the full court. B was charged with two offences (counts 1 and 2) of attempting to incite a girl under the age of 16 to engage in penetrative sexual activity (s 10). There was an offence of attempting to cause a child to watch a sexual act (s 12) (the maximum sentence for which was ten years’ imprisonment).
