He was sentenced to two years’ imprisonment. The Registrar of Criminal Appeals referred R’s application for leave to appeal to the full court. B was charged with two offences (counts 1 and 2) of attempting to incite a girl under the age of 16 to engage in penetrative sexual activity (s 10). There was an offence of attempting to cause a child to watch a sexual act (s 12) (the maximum sentence for which was ten years’ imprisonment).
