Supreme Court To Determine Whether New York's Strict Concealed Carry Laws Violate The Second Amendment

Font Size: The Supreme Court agreed Monday to hear oral arguments next term about whether New York State violated the Second Amendment when they denied concealed-carry licenses for self-defense – a ruling which could have massive nationwide implications. The case, New York State Rifle & Pistol Association v. Keith M. Corlett, will determine if New York’s “denial of petitioners’ applications for concealed-carry licenses for self-defense violated the Second Amendment.” New York bans open carry of handguns but allows for the concealed carry of handguns with a license, so long as applicants can prove “proper cause” exists. The state is a “may-issue” state, and licenses are issued at the local level by the county sheriff or court system.

U.S. Supreme Court takes major case on carrying concealed handguns

U.S. Supreme Court takes major case on carrying concealed handguns By Andrew Chung Reuters (Reuters) -The U.S. Supreme Court stepped back into the heated debate over gun rights on Monday, agreeing to hear a challenge backed by the National Rifle Association to New York state s restrictions on people carrying concealed handguns in public in a case that could further undermine firearms control efforts nationally. The justices took up an appeal by two gun owners and the New York affiliate of the NRA, an influential gun rights group closely aligned with Republicans, of a lower court ruling throwing out their challenge to the restrictions on concealed handguns outside the home.

Supreme Court Grants Cert in Second Amendment Concealed Carry Case

Supreme Court Grants Cert in Second Amendment Concealed Carry Case Ammoland Inc. Posted on IMG NRA-ILA U.S.A. -(AmmoLand.com)- Today the U.S. Supreme Court decided to hear an NRA-backed case challenging New York’s restrictive concealed-carry-licensing regime. This sets the stage for the Supreme Court to affirm what most states already hold as true, that there is an individual right to self-defense outside of the home. This case challenges New York’s requirement that applicants demonstrate “proper cause” to carry a firearm. New York regularly uses this requirement to deny applicants the right to carry a firearm outside of their home. The NRA believes that law-abiding citizens should not be required to prove they are in peril to receive the government’s permission to exercise this constitutionally protected right.
