Several court scuffles are underway as California moves toward finalizing the list of candidates for the September recall election that could oust Democratic Gov. Gavin Newsom from office during his first term.
Conservative talk radio host Larry Elder filed a lawsuit Monday challenging a decision by California election officials that blocked him from the contest, saying he’s the target of political “shenanigans” by Democrats who fear he’s a threat to Newsom.
Meanwhile, former San Diego Mayor Kevin Faulconer is expected in court to seek permission to identify himself as the “retired” San Diego mayor on the ballot, a label the state rejected. He qualified as a candidate but wants to use his title of choice.
SAN DIEGO (KUSI) – A judge Wednesday denied former San Diego Mayor Kevin Faulconer’s request to be labeled as the city’s retired mayor on the ballot in this year’s gubernatorial recall election.
Earlier this week, Faulconer’s campaign announced it planned to sue the Secretary of State’s Office regarding his ballot designation, alleging that no regulations prohibit the use of the word “retired.”
Secretary of State Shirley Weber’s court filings argue that Faulconer was termed out as San Diego’s mayor and thus did not voluntarily retire from the office.
Faulconer argued in court papers that he took the mayor’s job knowing he would eventually have to depart the office due to term limits, meaning he “voluntarily undertook a job that would, as a matter of law, force his early retirement from that job.”

LOS ANGELES (AP) – A California judge on Wednesday cleared the way for conservative talk radio host Larry Elder to join the field of candidates for an upcoming recall election aimed at removing Democratic Gov. Gavin Newsom from office.
Elder scored a swift court victory in Sacramento, where he challenged a decision by state election officials to block him from the September recall ballot.
In a tweet, Elder wrote, “Victory! My next one will be on Sept. 14 at the ballot box.”
He added: “This isn’t just a victory for me, but a victory for the people of California. And not just those who favor the recall and support me, but all voters, including many who will come to know me.”
