BRASILIA, June 23 (Reuters) - Brazil s Supreme Court on Wednesday confirmed its earlier ruling that a lower court judge had failed to treat ex-President Luiz Inacio Lula da Silva fairly in graft probes, a decision that could lead other cases against the left-wing leader to be thrown out.
With a vote of 7 to 4, the high court upheld the decision that former judge Sergio Moro was biased against Lula, throwing out a corruption conviction against the former president.
Lula s defense team has already requested that the Supreme Court evaluate whether other cases against Lula that were judged by Moro should be thrown out.
Mit sieben zu vier Stimmen hat das Plenum des Obersten Gerichtshofs „Supremo Tribunal Federal“ (STF) von Brasilien am Mittwoch (23.) den Prozess abgeschlossen, der die Kompetenz der zweiten Kammer des Gerichts anerkannte, den ehemaligen Richter Sérgio Moro bei der Verurteilung des ehemaligen Präsidenten Luiz Inacio Lula da Silva im Fall des „Triplex no Guarujá“ für parteiisch zu erklären. Mit der Anerkennung der Zuständigkeit der zweiten Kammer durch das Plenum wird die Entscheidung über die Befangenheit von Moro aufrechterhalten und der „Triplex-Fall“ muss von den Ermittlern von Grund auf wieder aufgenommen werden. Die bereits gesammelten Beweise werden für ungültig erklärt und können in einem eventuellen neuen Prozess durch das Bundesgericht des Bundesdistrikts, an den der Fall geschickt wurde, nicht verwendet werden.
RIO DE JANEIRO, BRAZIL - By a vote of 7 to 4, Brazil s Supreme Court (STF) decided today, June 23, to uphold the decision that recognized bias of former judge Sergio Moro in the conduct of the corruption trial of former President Luiz Inacio Lula da Silva in relation to the Triplex apartment in Guarajá, after an investigation by the Lava Jato task force.
In April, when the STF vote was still 7 to 2 on the question of bias, the proceeding was interrupted after a request by Justice Marco Aurélio to review the record.
