The United States asked Mexico on Wednesday to review whether workers at an auto parts factory were denied labor rights in the second labor complaint brought by the Biden administration under the new North American trade deal in less than a month.

US and Mexican trade unions have filed their first labour complaint against the government of Mexico under the under the US-Mexico-Canada free trade agreement (USMCA). The complaint, backed by union federation AFL-CIO in the US, argues that Mexico has not lived up to its pledge under the deal to guarantee workers the right to organise and join the union of their choice, rather than one previously hand picked by then employer. Their case centres on the Tridonex auto parts assembly plant in the Mexican border city of Matamoros, where workers have been fighting to form a new independent union rather than join existing pro-company “yellow” union SITPME.

By Mark Stevenson May 12, 2021 - 4:26 PM MEXICO CITY (AP) — The United States filed its first labor complaint with Mexico Wednesday under the U.S.-Mexico-Canada trade agreement, after an old-guard union was caught allegedly destroying ballots at a General Motors plant in northern Mexico. The U.S. Trade Representative invoked the “rapid response” mechanism under the trade pact, known as the USMCA. The mechanism allows a panel to determine whether Mexico is enforcing labor laws that allow workers to choose their union and vote on contracts and union leadership. If Mexico is found not to be enforcing its laws, sanctions could be invoked, including prohibiting some products from entering the United States.
