A fishery consulting firm working on the lower Stanislaus River says bass and other fish eat many juvenile salmon, and that the losses don’t appear connected to flows in the river.
A state plan would require more water in rivers, therefore unavailable for human use. The EPA is petitioning the Tenth U.S. Circuit Court of Appeals for three small refinery exemptions given to Sinclair Oil to be invalidated.

The EPA has filed a motion to remove biofuel waivers granted to the Sinclair Oil Corp. over questions on whether the waivers were allowed under previous court rulings.
Sinclair Oil Corp. received three biofuel waivers for the years 2018 and 2019 shortly before the Trump administration left office which exempted their oil production from federal biofuel requirements. These waivers have been a contentious issue after a 10th circuit court ruling in 2020 that argued some of the recently granted waivers had been inappropriately issued by the EPA. That ruling declared that these biofuel waivers could only be applied as continuous extensions to waivers granted in 2010, not as stand alone waivers, which would greatly limit the number of oil refineries that would qualify.
In Washington, Reuters reports the Environmental Protection Agency has filed a motion in the Supreme Court case currently being reviewed regarding how the EPA awards small refinery exemptions, with the motion saying the agency under the Trump Administration did not properly review Sinclair Oil’s applications. As such, the EPA is seeking the three waivers granted to Sinclair are vacated because the agency under the Biden Administration does not feel that under current rules it would be able to approve them.

IOWA - The Environmental Protection Agency is asking a federal court to throw out waivers allowing an oil company to avoid blending biofuels into its gasoline.
Iowa is a top producer of biofuels made with crops.
The EPA says it failed earlier under the Trump administration to find out if the waivers were allowed.
Three Iowa Democratic State Senators are praising the move as good news for the biofuel industry and Iowa farmers.
The EPA filing deals with three waivers given by the previous administration to Sinclair Oil refineries to exempt them from biofuel blending requirements.
