A Colorado Springs metal worker has filed federal charges against his former union for allegedly demanding tens of thousands of dollars in retaliation for his leaving the union, according to a Tuesday news release.
Russell Chacon filed charges against Local Chapter 9 of the Sheet Metal, Air, Rail, and Transportation workers’ union after receiving a message ordering him to pay $21,252 to make up for a “loss of funds” stemming from his choice to seek employment with a nonunion firm.
Chacon, a former employee of Colorado Springs-based contractor Colorado Sheet Metal, formally resigned his membership with the union in November 2020 when he elected to take a job with Rocky Mechanical, a Pueblo-based firm that is not affiliated with the union.
(The Center Square) â A metal worker in Colorado Springs filed a federal lawsuit on Tuesday alleging that the International Association of Sheet Metal, Air, Rail, and Transportation Workers (SMART) Local 9 union officials was trying to fine him for more $20,000 in lost union dues.
Russell Chacon, a former employee of Colorado Sheet Metal, a Colorado Springs-based contractor, alleges the SMART union bosses are attempting to make him pay $21,252 in a âloss of fundsâ fee after he worked for another contractor outside of the unionâs bargaining power.
In the lawsuit, Chacon contends that the fines levied against him include work that he has not yet performed. He had also resigned as a union member prior to working for the other contractor.

A former aide to U.S. Rep. Doug Lamborn sued the Colorado Republican and his congressional office Thursday, alleging the congressman was willing to sacrifice the health and safety of his employees by disregarding safety concerns during the COVID-19 pandemic, even as the virus infected Lamborn and multiple staff members.
The lawsuit, filed in U.S. District Court for the District of Columbia, also accuses Lamborn of firing the aide in retaliation after he raised concerns about workplace conditions.
Brandon Pope, Lamborn s military adviser until early December, also charges in the lawsuit that Lamborn required his congressional staff to run personal errands and perform tasks unrelated to their jobs for Lamborn and his wife, such as buying the couple Christmas and birthday presents and helping move furniture to the Lamborn s vacation home.
