A decision is expected Tuesday from Judge Timothy S. Hillman.
Mark Bray, 22, of Shrewsbury is accused of groping a female student at a campus party in November.
Bray denies the accusation and in the injunction filed by his attorney, claims that the university hearing was discriminatory. Bray is Black and the victim is white.
“This is an unfortunate case,” said Adam Beck, lawyer for student Mark Bray, in U.S. District Court. “My client is a good student, he’s on the track team, set to graduate with multiple honors.”
After a hearing at the university went against Bray, he was asked to leave the campus and he was removed from consideration for any awards and honors.
An attorney for the student, Mark Bray, 22, of Shrewsbury, has filed a motion for a temporary restraining order and preliminary injunction that would allow him to graduate with his class.
