Garland Restores Courts Power To Pause Deportation Cases
Law360 (July 15, 2021, 7:57 PM EDT) U.S. Attorney General Merrick Garland restored a temporary form of relief for individuals in deportation proceedings, saying Thursday that a Trump-era decision curbing immigration judges authority to pause lower-priority immigration cases went against long-standing practice.
Garland overturned a binding decision from former Attorney General Jeff Sessions in Matter of Castro-Tum that barred immigration judges and the Board of Immigration Appeals from administratively closing deportation cases. The U.S. Department of Justice, under the purview of Attorney General William Barr, another Trump appointee, had codified Castro-Tum through a final rule.
