●记者走访20多位新业态劳动者发现，所有受访者每日工作时间均超过12小时且是常态，有的受访者为了工作经常一周无休.接受采访的专家认为，新业态劳动者超时工作，既违反劳动法律法规，也使自身的休息权受到侵害，还破坏了工作和生活的平衡关系，亟须通过完善法律制度来改变这一局面。而工作时间过长会导致劳动者过劳，长期过劳则会带来身体上的损害， “超长时间工作容易导致劳动者沦为一个工作的机器” 。他解释说，新业态从业人员多通过平台等进行工作，在线时间比较灵活，其工作时间计算很难通过既有的按时上下班的工时计算规则来完成，需要进行专门的制度设计。”李海明说。
