BBI Must get to referendum, Controversial MP declares By Catherine Waruguru via FB In the spirit of our Constitution, we respect the ruling delivered by the High Court yesterday. There is need for immediate appeal to the decision as some key issues raised by the BBI team haven’t been sufficiently prosecuted. On March 4th 2020, in a case filed by Thirdway Alliance against the BBI task force, Justice Mativo of the High Court ruled that the taskforce was constituted legally and that the President acted well within the law in constituting and gazzetting the task force. It’s astonishing to see the High Court making two conflicting judgements.

I assure all of you that there’s nothing to worry about. Today’s court decision will ONLY make this weekend a very active one politically. TangaTanga is on cloud 9. We are sure we are okay. Each side will argue it’s position – some will pontificate. Everyone will sound right; like they know. But that’s it. Nothing will actually change. Because next week this decision will be appealed; and overturned. We will then realise that #BBI has not stopped moving forward. In addition, over the next few days we will also learn exactly what the Judges were trying to do with this judgement; what they hoped to achieve (but wouldn’t). We will learn that this wasn’t actually about the case that was before them in court.

AG Kihara Takes Action After BBI Ruling Attorney General Paul Kihara Kariuki. File Solicitor General Ken Ogeto stated that the AG was directly authorised to appeal against the ruling.  Kariuki filed a suit in court seeking an injunction against the implementation of the judgement made. The suspension would provide him with ample time to file for an appeal.  The former President of the Court of Appeal - through the Solicitor General - argued that he was displeased with the shock ruling made against BBI, especially after the judges declared that the bill illegal as it flouted several clauses of the Constitution.
