Domingo Cayosa said Sunday. Cayosa previously mentioned that there is no explicit provision in the 1987 Constitution that bars President Rodrigo Duterte from running as Vice President. Section 4, Article 7 of the Constitution says: The President shall not be eligible for any re-election. No person who has succeeded as President and has served as such for more than four years shall be qualified for election to the same office at any time.

The Constitution does not prohibit President Duterte from running as vice president in the 2022 elections. But, Domingo Egon Q. Cayosa – immediate past president of the Integrated Bar of the Philippines (IBP) – said Duterte’s candidacy for vice president next year can be challenged before the Supreme Court (SC). Cayosa pointed out that not anyone else can go to the SC. Only someone who will run for the same office next year would have the legal standing to file a petition, he stressed. The issue was discussed by Cayosa after Duterte’s announcement that he will seek the post of vice president in next year’s elections.

Published July 2, 2021 1:14pm President Rodrigo Duterte can run for vice president in the May 2022 elections since such a scenario is not expressly prohibited by the 1987 Constitution, the head of the Integrated Bar of the Philippines (IBP) said Friday. “The Constitution does not explicitly prohibit a president from running for another office after his term as president. What it prohibits is a reelection,” IBP president Domingo Cayosa said. “[There is] no express legal impediment.” Former presidents Gloria Macapagal-Arroyo and Joseph Estrada were elected as Pampanga congresswoman and Manila mayor, respectively, after leaving Malacañang. Cayosa’s statement comes after Duterte announced on Thursday that the public should consider him a candidate for vice president “at this time” amid calls from his party-mates in PDP-Laban to gun for the country’s second highest elective post.
