OPELIKA The Alabama Court of Criminal Appeals upheld the conviction of an east Alabama man in the murder of his girlfriend.
Timothy O’Neal James, 37, was convicted of the murder of Darlene Little, in January 2020. A year later, an appeal was denied.
Prosecutors said on June 10, 2017, James called the Opelika Police Department and reported Little shot herself. During the trial, the state’s forensic witness said the location of the wound to Little’s head would have made it difficult for her to shoot herself.
“At trial, James testified that he was holding the gun when it was fired, contrary to his initial statements to police, but claimed that the shooting was an accident,” said Attorney General Steve Marshall.
