NORRISTOWN â A judge has dismissed homicide-related charges against a Pottstown man who had been accused of conspiring with three others in the March 2019 gunshot slaying of another borough man.
In an order issued on Monday, Montgomery County Judge William R. Carpenter dismissed charges of first- and third-degree murder, conspiracy to commit murder, receiving stolen property and possessing an instrument of crime against Elijah Davis, 20, of the 300 block of Spruce Street.
Carpenter ruled prosecutors âfailed to establishâ sufficient evidence to proceed to trial on the charges lodged against Davis. The judgeâs ruling came after a review of testimony presented at an October 2019 preliminary hearing and at a pretrial hearing last week.
