Washington: The Biden administration has announced that it is delaying the H-1B policy of the previous Trump administration on allocation of the popular foreign work visas by continuing with the lottery system until December 31, 2021, to give the immigration agency more time to develop, test and implement the modifications to the registration system.

In a January 15 letter to Mayorkas, Sen. Chuck Grassley (R-IA) alleged that the former USCIS chief has not been transparent about his role and involvement in a series of EB-5 visa cases. Mayorkas was reported by multiple USCIS staffers for intervening in three specific EB-5 visa cases where foreign investors had been denied visas. In 2015, Obama’s DHS IG John Roth documented the inappropriate actions.

H-1B Cap, Prevailing Wage Rule and International Travel Updates

Wednesday, January 20, 2021 H-1B Cap Selection Process On January 8, 2021, U.S. Citizenship and Immigration Services (USCIS) published a final rule modifying the H-1B cap selection process. This rule changes the H-1B cap selection process by replacing the random selection process with a wage-level-based selection process, giving preference to petitions using a Level IV wage and proceeding in descending order with wage levels III, II and I. This affects only new, cap-subject H-1B petitions. It  does not affect people who currently hold H-1B status. The rule is scheduled to go into effect 60 days after publication (March 9, 2021), however, it is unclear if it will be implemented in time for this year’s cap process.
