UHS Data Breach Lawsuit Proceeds
A lawsuit filed against an American healthcare provider over a 2020 data breach has been allowed to proceed, but only for one patient.
The patient, Stephen Motkowicz, claims that his surgery was canceled as a result of a ransomware attack and subsequent data breach at Universal Health Services (UHS).
UHS employs around 90,000 people at the approximately 400 care centers and hospitals it operates in the United Kingdom, Puerto Rico, and the United States.
Sensitive data belonging to UHS was exfiltrated in September last year when the company was targeted by the Ryuk ransomware gang.
All UHS sites in Puerto Rico and the US were affected by the cyber-attack, which caused the company s IT systems to go offline for a month. Some scheduled appointments were postponed as a result.

Graham, Angela Morgan, and Stephen Motkowicz have sued Universal Health Services due to claims that the healthcare company failed to protect their health information during a ransomware attack that occurred in September 2020. The plaintiffs argued that Universal Health Services was negligent and breached an implied contract, fiduciary duty, and confidence. These four violations, as described by the plaintiffs, caused them to be susceptible to increased risk of identity theft and lose time and money due to the need to monitor their accounts for fraud.
Motkowicz presented an additional claim, arguing that the security violation led to increased health insurance expenses on his behalf. When the private health information and insurance was compromised, Motkowicz was forced to delay his scheduled surgery due to the hold on his insurance, during which time he was unable to work because of his medical condition.
