DC Circuit Vacates Trump s Ace Rule and Deals Biden s EPA New Hand for Regulating Power Plant Greenhouse Gas Emissions Tuesday, January 26, 2021
On 19 January 2021, the eve of inauguration for the Biden Administration, the United States Court of Appeals for the District of Columbia Circuit (D.C. Circuit) struck down the Affordable Clean Energy Rule (ACE Rule).
1 Issued under the Trump Administration’s Environmental Protection Agency (EPA), the ACE Rule repealed and replaced the formerly enacted Clean Power Plan (CPP)
2 and sought to establish a more narrowly defined framework for the regulation of power plant greenhouse gas (GHG) emissions.
3 As a premise for the ACE Rule, the Trump EPA argued that Section 111 of the Clean Air Act (CAA), codified at 42 U.S.C. § 7411, contains clear and unambiguous language limiting the EPA’s emission reduction measures to improvements “at” and “to” existing GHG emissions sources.

UPDATE: March 8, 2021: The U.S. EPA has asked a court to vacate the rule meant to delay implementation of 2016 landfill methane emission guidelines and send it back to the agency to review. The agency filed an unopposed motion in the U.S. Court of Appeals for the D.C. Circuit on March 4, saying it would issue a federal plan by May 2021 for any state that does not have an approved plan for implementing the regulation.
The EPA argued vacating the case would not cause “deleterious effects on public health and the environment” because it would not affect the timeline for establishing the federal plan by that date. The EPA under the Trump administration proposed a federal plan in August 2019, giving itself two years to promulgate necessary state plans.

Yesterday was also an important day for Mother Nature and the nation. The US Court of Appeals for the District of Columbia Circuit unanimously tossed the Trump administration s replacement for Obama s Clean Power Plan (CPP) back to EPA. The Agency will now be coming out with some version of the CPP.
Look for my continuing comments on these and other Biden administration efforts to put the nation s economy on a low-carbon trajectory.

The new strategy has been published in the Foundation s new position paper and is in recognition of the impact that air emissions of hazardous chemicals may have in communities and the environment.
The paper is the result of the collaborative effort that included representatives from relevant stakeholder groups with the aim to minimise air pollution across the textile, apparel, leather and footwear value chain.
