The plaintiff, Heide Bartnett, also sued Alight Solutions, the plan’s recordkeeper, and that case will still go on. An identity thief managed to get the bulk of Bartnett’s 401(k) assets transferred to a brand-new bank account, Bartnett has been able to recoup about $108,000. Bartnett claimed that Abbott Labs breached its fiduciary duty by hiring Alight, and allegedly failing to monitor it. In the complaint, Bartnett pointed to other instances of retirement accounts at Alight being compromised, as well as an investigation by the Department of Labor.

Smithfield Foods: Illinois man sues Smithfield after injury at plant

View Comments An Illinois man has filed a federal lawsuit against Smithfield Foods after being injured at its Sioux Falls meatpacking plant in 2017. Robert Willison, a trucker from Tinley Park, Illinois who worked for American Pride Transportation, originally filed the lawsuit in the U.S. District Court for the Northern District of Illinois Eastern Division on Dec. 21, 2020. But the case was transferred into the U.S. District for South Dakota last week. Willison alleges that on Dec. 20, 2017, he slipped and fell on snow- and ice-covered pavement at a weighing station at the Sioux Falls plant, after a security officer told him to load his trailer there.

Maintenance workers allege they were paid mileage reimbursement instead of overtime pay

LOUIS An Illinois-based real estate brokerage and its maintenance company are being sued for allegedly failing to pay workers overtime pay.  Kyle Jurcich, individually, and on behalf of all others similarly situated, filed a complaint April 2 in the U.S. District Court for the Southern District of Illinois Eastern Division against Christone Enterprises Inc., E.L.M. Construction Inc., Christopher Mendola P. and Christopher B. Mendola, alleging violation of the Fair Labor Standards Act and violation of the Illinois Minimum Wage Law.  According to the suit, the defendants handle more than 13,000 rental units. Jurcich claims he was a full-time maintenance technician for the defendants from August 2016 through December 2016. He was paid various hourly rates of between $12 and $17 per hour for primary duties consisting of non-exempt manual labor and worked between five and 25 hours of overtime.
