To embed, copy and paste the code into your website or blog: On January 20, 2021, President Joseph Biden issued Executive Order No. 13990 (“Executive Order”), which, among other things, suspended Executive Order 13920, “Securing the United States Bulk-Power System” (“Executive Order 13920”) until April 20, 2021 and directed all executive departments and agencies to review and take action to address all actions taken during former-President Donald Trump’s tenure in office that conflict with President Biden’s stated goals of improving public health, environmental protection, reducing greenhouse gas emissions, bolstering resilience to the impacts of climate change, and confronting the climate crisis. In the Executive Order, President Biden suspended Executive Order No. 13920 for 90 days, until April 20, 2021.  During such time, the Secretary of Energy and the Director of the Office of Management and Budget (“OMB”) are required to jointly consider whether to recomm

Will the New Congress Reverse Any Midnight Rules? | Insights

Share With the outcome of last week’s Georgia Senate runoff elections producing a 50-50 Senate ratio and giving Senate Democrats majority status, there is renewed interest in the Congressional Review Act (CRA) (5 U.S.C. 801 et seq.). Under the CRA, a new Congress can act within its first 75 days of legislative session to reverse “major rules” promulgated by federal agencies during the last 60 legislative days of the previous Congress. In 2017, Congress used the CRA to pass “resolutions of disapproval” and nullify 16 different federal regulations promulgated in the last months of the Obama Administration. Under the statute, CRA resolutions are considered under expedited procedures and not subject to Senate filibuster rules. This means a simple majority – including all 50 Democratic (and left-leaning independent) senators plus incoming Vice President Kamala Harris breaking a tie if necessary – could pass such a resolution of disapproval in the new Senate.

Biden Orders Immediate Confrontation of Climate Crisis

Biden Orders Immediate Confrontation of Climate Crisis On Jan. 20, President Joe Biden signed an executive order entitled, “Protecting Public Health and the Environment and Restoring Science to Tackle the Climate Crisis.” It establishes the Biden administration’s commitment to immediately work to confront both the causes and impacts of climate change by implementing policy guided by science. The order rolls back many actions taken by the Trump administration to loosen environmental standards and protections and calls on all federal agency heads to review and “consider suspending, revising, or rescinding the agency actions” that may be inconsistent with Biden’s articulated policy. It also effectively recommits the U.S. to the 2015 Paris Climate Accords, a multilateral treaty designed to reduce carbon emissions and address climate change, which President Trump withdrew the U.S. from in 2017.

Biden s Executive Order to agencies to review all of the Trump era climate regulations

1209 views As a favor to the community I m posting President Biden s order to agencies to undertake a review of Trump era environmental regulations. Yesterday was also an important day for Mother Nature and the nation. The US Court of Appeals for the District of Columbia Circuit unanimously tossed the Trump administration s replacement for Obama s Clean Power Plan (CPP) back to EPA. The Agency will now be coming out with some version of the CPP.  Look for my continuing comments on these and other Biden administration efforts to put the nation s economy on a low-carbon trajectory. In the meantime, feel free to ask questions you might have. I ll do my best to answer them.
