Where Title IX ends and gray begins: OU case illustrates how federal guidelines limit screening, handling of previously accused employees

Editor’s note: This story contains mentions of sexual assault.  Despite facing a rape allegation that camp leaders were aware of, an OU student was hired to work at Camp Crimson — a situation one national expert said administrators had limited options in preventing due to privacy laws and Title IX regulations.  Courtney Foster, Norman Women’s Resource Center assistant director, said a freshman orientation setting can be particularly vulnerable for students entering college for the first time, and involving someone even accused of rape can be dangerous due to the nature of the crime. Master s student says OIE mishandled her investigation

What about the fact that he almost ruined mine?” These are the words of a master’s student describing the investigation the Office of Institutional Equity (OIE) conducted after she reported her sexual assault. The News-Letter granted her anonymity to protect her privacy; she requested the pseudonym Zhang.  Zhang filed her complaint in the fall of 2020. Although OIE’s investigation eventually found the perpetrator guilty of sexual assault, the resolution panel decided not the punish the perpetrator. External review panels are composed of two trained University faculty or administrators and one additional retired judge or legal professional chosen by the Title IX coordinator.

Michigan State Publishes Sexual Misconduct Prevention Plan By   Michigan State University published a new strategic plan Tuesday that addresses how the university will work to prevent sexual misconduct and relationship violence on its campus. The plan comes after years of policy review by administrators and faculty experts, discussions with survivors of sexual assault and their families, and campus surveys following the sex abuse case involving former USA Gymnastics and university team doctor Larry Nassar, which came to light in 2016. According to a report outlining the plan, the university will initiate a campuswide culture shift toward more trauma-informed responses to reports of sexual misconduct, in order to encourage victims to seek help.
