Genocide denial ban: Serbian leader threatens dissolution of Bosnia

July 24, 2021 Sarajevo: The Serb member of Bosnia’s joint presidency on Friday threatened the dissolution of the country, after the outgoing UN high representative used his discretionary powers to ban genocide denial. The UN official in Bosnia holds some executive powers in the Balkan country that was the scene of the 1995 Srebrenica massacre, of Muslims. Austrian diplomat Valentin Inzko, whose main role as high representative is to oversee the Dayton peace agreement that ended the bloody 1990s inter-communal conflict, made the decision a week before handing over to German colleague Christian Schmidt. Inzko added several amendments to the Bosnian Criminal Code, including providing penalties of between six months and five years in prison for those who publicly approve, deny, grossly minimise or attempt to justify the crime of genocide, crime against humanity and war crime, according to a document on the website of the Office of the High Representative.

Valentin Inzko used his power to impose an amendment to outlaw the public denial, condoning, trivialization or justification of genocide, crimes against humanity or war crimes when it is done in a way that is likely to incite to violence or hatred. Inzko, whose mandate will expire at the end of July, said in a message published on the website of the Office of the High Representative of Bosnia and Herzegovina (OHR), that the long-awaited law on the punishment of genocide denial will take effect temporarily until a vote in the Parliamentary Assembly of Bosnia and Herzegovina takes place.

Explanation of Vote Abstention - Bosnia & Herzegovina Statement 23 July 2021   I would like to set out Ireland’s position on this issue and decision to abstain from today’s vote.     Ireland fully supports the Office of the High Representative and believes that its role remains vital to the work of building a stable and prosperous future for Bosnia and Herzegovina.   We welcome the PIC Steering Board decision on the appointment of Mr Christian Schmidt as High Representative and look forward to working with him.   Our clear view is that the expression of support by this Council is not legally necessary for the decision of the PIC Steering Body to appoint a new High Representative to take effect. We are open in principle to a resolution welcoming and agreeing to the appointment of the new High Representative.
