WHEELING Ohio County Public Service District says three companies have wrongfully occupied land owned by the PSD and caused damage.
American Tower Corporation, American Towers LLC and CellCo Partnership were all named as defendants in the suit.
The PSD claims ATC owns and operates a cell tower that is trespassing on PSD property, according to a complaint filed in Ohio Circuit Court.
CellCo leased land from Triple P LLC in 2015 and CellCo subleased the property to ATC, however, the cell tower exceeds the bounds of the leased premises and encroaches on PSD s property.
The plaintiffs claim the defendants placement of the cell tower is a deliberate and continuous physical invasion on the PSD s property and the defendants actions have substantially and unreasonably interfered with the PSD s private use, enjoyment and general possession of its land.

The Canada Pension Plan Investment Board is boosting its interest in Indian infrastructure conglomerate IndInfravit Trust, after agreeing to pay $173 million for an additional 15.9 per cent of the toll road operator.
The deal, which is scheduled for completion by the middle of May will take the CPPIB’s total stake in the investment trust to 43.8 per cent. Since its launch in 2018, IndInfravit’s has acquired 13 operational road concessions along critical national transportation corridors linking cities in the high-growth Indian states of Karnataka, Maharashtra, Rajasthan, Tamil Nadu and Telangana.

The infrastructure-investor rush into Europe continues. A new UK investment trust, Cordiant Digital Infrastructure, has made its first two investments: a mobile tower business in Czechia (the Czech Republic) and a fibre network in Norway.
Cordiant Digital Infrastructure is an offshoot of Cordiant Capital which has an established presence in the telecoms. It set up the new fund to address the infrastructure side of the business and the long-term, steady returns such assets are expected to provide.
First steps into Europe
Cordiant Digital Infrastructure paid £451 million (€522.23 million) for telecoms and TV towers firm České Radiokomunikace (CRA) and an anonymous Norwegian fibre network plus land.
