Statewatch | Frontex: European Parliament scrutiny group begins inquiry into rights violations allegations

Frontex: European Parliament scrutiny group begins inquiry into rights violations allegations 23 February 2021 A permanent European Parliament scrutiny group began work today to “oversee all aspects of the functioning of Frontex”. Launched on 29 January by MEPs in the European Parliament’s civil liberties committee (LIBE), the group is mandated to spend its first four months investigating the allegations of involvement in fundamental rights violations that have dogged the agency since October 2020. Two MEPs from each political group in the European Parliament will act as standing members of the working group, which will spend its first four months conducting a fact-finding investigation into all aspects of Frontex’s functioning, before producing recommendations.

Statewatch | Frontex: Management Board pushes back against secrecy proposals in preliminary report

The report discusses Frontex’s plans to update the Serious Incident Reports (SIR) mechanism, full details of which it did not share with the working group despite a request for the information. As part of these updates Frontex intends to classify all SIRs as RESTRIENT UE/EU RESTRICTED (the lowest level of EU Classified Information, EUCI), and all SIRs would be handled by the Frontex Situation Centre. The working group finds this proposal inappropriate and, in fact, contrary to Frontex s founding legislation: Serious Incidents regarding alleged violation of Fundamental Rights should not be reported to Frontex Situation Centre but should be directly reported to the Fundamental Rights Officer, for follow-up in accordance with his or her competences, as set out in Article 109 (2) (b) of the EBCG Regulation

Moreover, it found that Frontex recently remained in Hungary after the European Court of Justice (ECJ) ruled in December that Hungary breached EU law by failing to provide asylum seekers and migrants full access to international protection offered in EU law. The HHC said that it received reports in 2016 of violence at Hungary’s border and wrote to Frontex requesting investigation and prevention of the violence. The Executive Director of Frontex Fabrice Leggeri responded that it had received “no allegations of violation of fundamental rights by the officers deployed by Frontex in Hungary,” and if such allegations were received, there would be immediate action if
