the january 6th cases i ve covered thus far, where that is just really been shot down and the voir dire process can actually work, if you have jurors swear an oath and promise they will obey that, oh they can handle these cases fairly. yeah. i feel like she really went for the defense s achilles heel by suggesting not talking about fines, nothing about jail time but the thing that they do not want to do, which is have a speedy trial. dave, what is involved, i guess for those of us who don t understand the sort of length of time that is minimally required to have a federal trial. how reasonable is it to say i m going to move this date up the more you infringe on the protective order? what practically can that mean? i think there are limits to what it practically can mean. it s not as though every time there is a violation the trial date gets ratcheted two weeks or earlier. that would not be workable. i think it is more of a
acquittals on certain charges for several counts, not the charges overall. there have been other acquittals in january 6th cases all together. they have some evidence that the voir dire process can work here, that jurors can swear their oath, can take the evidence on its face. despite, you know, maybe not being particularly fond of donald trump, can look at the facts and decide them fairly. you know, when chuck was talking about the first amendment grounds, it struck me that potentially one thing you d expect if that s going to be the defense of trump here, they d be calling for the charges against hunter biden in the gun case to be dropped. then hunter biden has a first amendment right to lie about being a drug addict on a gun form. that s just, you know i think chuck is right, that that is not something that is going to have much merit in this courtroom behind me, and especially, you know, given the judges who know a lot of the facts about these cases. yesterday, we saw another def
call it his inability to understand and to appreciate reality. the defense attorney is going to say that he has a distorted view of reality and that his actions were not logical, were not rational. we re also going to hear system from the survivors, we re going to hear from family members, we re going to hear from those individuals who lost their loved ones and the impact that the loss of those loved ones have had on their lives. it s going to be a very emotion and difficult part of this trial. do you expect the same jury that came back with guilty on all 63 counts, listen to this very emotion testimony from this witnesses, do you expect them to come back with a death penalty? what we know, amara, is that all of these jurors had to acknowledge during the voir dire process that if the evidence supported a finding for the death penalty that they would be able to make that determination. we know there s some individuals
they will move into the next phase to decide whether or not the death penalty is going to be impose and you are right in what is called voir dire process, jurors, potential jurors were screened for their ability to keep the open mind with respect to whether or not to impose to death sentence. some people are morally oppose opposed to the death penalty. what does it mean that it is only five hours. i have seen others returned quickly, but five hours is very fast, because they have decide on dozens of charges here. the defense is not mistaken identity, and i did not engage in these acts, and they are specific legal defenses to the 22 capital charges. in order to get the federal charges bumped up to hate crimes, the prosecution has to
