SLO County BLM protester appeal headed back to the appellate court

In the latest legal round regarding a group of Black Lives Matter protesters who blocked Highway 101 in San Luis Obispo last summer, the appellate court reversed their earlier decision not to hear an appeal of Judge Matthew Guerrero’s recusal of county prosecutors.
In early January, the attorney general filed two appeals regarding Guerrero’s finding the SLO County District Attorney’s Office had a conflict of interest, one in the felony case against Robert Lastra the protester who allegedly smashed a car window onto a 4-year-old boy and one in the misdemeanor filings against the remaining six defendants. Generally, the 2nd District Court of Appeal hears felony appeals, while a panel of three SLO County Superior Court judges rule on misdemeanor appeals.

BLM protesters file opposition to San Luis Obispo DA s request for gag order

Protestors charged following a Black Lives Matter protest in San Luis Obispo are filing an opposition to the District Attorney s request for a gag order.
In March, District Attorney Dan Dow filed a gag order against the seven protestors facing charges for their involvement in the July 21 protest that went onto Highway 101 and through several city streets of San Luis Obispo.
The gag order would prevent them and their attorneys from speaking publicly about the case.
This week attorneys for Tianna Arata and Sam Grocott filed their oppositions to that filing, saying in part, the gag order restricts their first amendment rights to speak about an elected official.

The San Luis Obispo County District Attorney s Office filed a motion on March 26 seeking a gag order against Tianna Arata and three other Black Lives Matter protesters and their respective attorneys, citing a collective media campaign that s influencing the county s jury pool. On March 29, about 40 people gathered in front of the DA s Office holding signs that read Stop silencing Black voices and Dan, you already got disqualified, give it up.
