Malaba demands JSC probe

UNDERFIRE Chief Justice (CJ) Luke Malaba has reportedly ordered an investigation into circumstances leading to a private meeting between Judicial Service Commission (JSC) head of secretariat Walter Chikwana and Supreme Court judge, Justice Webster Chinamhora ahead of a hearing that could impact his stay at the apex of the Judiciary.
Justice Chinamhora recused himself from the three-judge panel before it heard an application seeking the arrest of Malaba for defying a High Court ruling that he was no longer CJ.
Critics say the meeting between Justice Chinamhora and Chikwana was meant to put pressure on the judges ahead of the hearing, potentially compromising the judges.

TWO High Court judges Thursday reserved to next week their judgment in an urgent application filed last week by the Human Rights NGO Forum demanding the imprisonment of Luke Malaba of being contempt of court charges.
The application was filed by the NGO Forum after Malaba, whose five-year extension as the chief justice was ruled to be unconstitutional last month, defied the High Court order, and has continued reporting for duty at the Constitutional Court.
Thursday’s High Court bench constituted two judges, Justices Amy Tsanga and Sylvia Chirawu-Mugomba. This was after Justice Webster Chinamhora recused himself from hearing the matter.

THE executor of Genius Kadungure’s estate has been stopped from administering the estate of the late socialite and businessman, pending finalisation of the dispute.
Popularly known as Ginimbi in social circles, Kadungure died in a horrific car accident last year.
The court ruling comes after the late Ginimbi’s sisters; Juliet and Nelia, and his father Anderson Kadungure, approached the High Court suing lawyer Ms Patricia Darangwa.
They wanted an order stopping any administration of an unsigned will presented by Ms Darangwa on November 25 pending a High Court review on why the Master of High Court appointed her as the executrix.
