MUMBAI: Is the development manager who signs an agreement with a builder for exclusive rights to sell flats liable to pay compensation to the buyer in case of delay or does liability rest only with the builder? A RERA order on March 5 said both were liable in a Mulund project, reports Swati Deshpande.
MahaRERA directed the development manager, a subsidiary of Shapoorji Pallonji Group, and Nirmal Developers, to refund the money paid by four flat purchasers with 9% interest for delay in construction and possession of flats.
MahaRERA member B D Kapadnis said the DM would be considered a ‘promoter’ of the project along with the builder Nirmal Developers. Mumbai: Bombay HC held as maintainable, a husband’s appeal against a common judgment of a family court passed after clubbing of divorce proceedings and monetary and protective relief sought under Domestic Violence Act (DVA).
The wife had raised preliminary objection to maintainability of the appeal before HC, arguing that parts relating to DVA need to be separately challenged under a criminal revision application.
The family court had granted the wife divorce on grounds of cruelty, but held that she had proved acts of domestic violence by him and granted maintenance to her and their child. The court restrained the husband from interfering with custody of the child and over a flat, and said she was entitled to damages, as claimed in DV proceedings.

MUMBAI: The Maharashtra state cooperative appellate court has said a tenant or a leave and licence holder has the right to park their car in the space allotted to a member on the society premises. It has “temporarily restrained” a cooperative housing society at Nepeansea Road from preventing a flat owner from allowing a person who had rented his flat to use his parking slot, reports Swati Deshpande.
The February 9 judgment said that the only question that arose for consideration was “whether the licensee can enjoy the alloted parking space which is allotted to.the member of the society?” It added, “A car parking space allotted to the owner can be used by the tenant as he has full rights over it.”
