South Africa's claim against Israel is based on the United Nations Convention on the Prevention and Punishment of the Crime of Genocide, ratified in 1948. South Africa must prove the facts attributed to the Israeli entity, as well as the existence of a "systematic pattern" of acts "with the intent to destroy, in whole or in part, a national, ethnic, racial, or religious group" The International Court of Justice has ruled in its jurisprudence that any member with an interest in the prevention of genocide may bring a claim before the Court.
