rod. reporter: i have dennis mcandrews. an attorney who has seen about every day. he was in the courtroom when this happened. you ve practiced law a long time. what do you think of this decision? i think it s a very appropriate decision. it was a serious offense, and judge o neal set out all the reasons for the offense. the fact that the public needed to be protected. there needed to be retribution, and you had to respect the impact of the victim and her family. reporter: what did you see from the other accusers? there was a relief that the sentence was significant and a state sentence. and that he ll be incarcerated for at least the next three years and probably more. you think this is appropriate? you think this sends a message. we ve been saying how we think this case is about more than cosby. it s appropriate in it s right around where the pennsylvania guidelines say somebody who committed this type of offense should receive.
this after being convicted of drugging and sexually assaulting andrea constand in 2004. cnn legal analyst areva martin joins us now. as you look at this case here, our understanding is 30 years would be really the outer end of what a sentence might be, right? that the judge on these three counts might have him serve concurrently. what s a realistic expectation for his sentencing? when you look at the data in terms of how judges in this particular county and this state sentence people who are in similar situations as bill cosby, meaning individual s convicted of the kinds of felonies he s been convicted of with no prior record, the data suggests the sentencing looks like from 22 months up to three years. i think that s a more realistic range when we think about what bill cosby is facing today. we know that he s 81 years old. his defense team is arguing that he s failing in his health. and they re going to use those factors to try to argue for a
it s real. reporter: mitchell is serving a life sentence while barzee was initially supposed to be released in 2024. last week her 15-year state sentence should include the time she spent in federal prison, which means her sentence has now been served. to my knowledge in my position there s no credible evidence she s a danger to the community. reporter: at age 72 barzee is now listed on utah s sex offender registry and will be on probation for five years. smart is choosing to focus on the future, not her painful past. well, the president said that his health will help republicans during the midterms, telling the hill tv, i think this, we probably have the greatest economy in history, so they ve tried many narratives with me. you know, i took that test when i got my last physical and the doctor said that s one of the highest scores we ve ever seen. i did that not because i wanted but i did it.
to help you. reporter: for nine months, smart was held captive by barzee and her husband at the time brian david mitchel. there were times when yes she was manipulated by mitchell. but she in her own right abused me just as much as he did. reporter: mitchell is serving a life sentence and barzee wasn t supposed to be released until 2024. but last week utah s parole board ruled her 15 year state sentence must include time she spent in federal custody which means her maximum sentence has been served. she will now be on probation for five years. she is as far as i m concerned as unstable as she was back when they abducted elizabeth. you can be assured that wanda barzee will be closely monitored and if she falls off track of what her requirements are, that that is a very short leash. reporter: federal officials say they have found a place for barzee to live when she s released, but won t say where. barzee s niece says she doesn t
