CHARLESTON A motion by the West Virginia Republican Party to intervene in a case that could determine who represents Wayne County in the House of Delegates was approved Friday by the state Supreme Court of Appeals.
J. Zak Ritchie, an attorney for the state Republican Party, filed a motion to intervene in a mandamus lawsuit filed by Wayne County Republican Executive Committee Chairman Jeff Maynard asking the court to require Gov. Jim Justice to choose a delegate for the vacated 19th District House seat in Wayne County from a list of three qualified nominees submitted by the county party.

Gov. Jim Justice has appointed a new person to replace a former state delegate who resigned earlier in January following federal charges for participating in an insurrection that turned violent at the U.S. Capitol.
Justice’s appointment is met by a 17-page writ of mandamus from a local Republican leader, arguing that the governor violated state laws with his final pick for office.
Joshua Booth, a Republican in Kenova, Wayne County, will join 99 others in the House of Delegates for the 2021 legislative session on Feb. 10.

CHARLESTON Gov. Jim Justice announced Wednesday the appointment of Wayne County Republican Joshua Booth to replace Derrick Evans, the former delegate who resigned after accusations of illegal entry into the U.S. Capitol on Jan. 6, even as a lawsuit challenging the governor’s selection is pending.
“He is being appointed and I’m making that appointment today,” Justice said Wednesday. “I feel very, very confident that Joshua Booth will do a wonderful job for the people of West Virginia.”
