Rocking R Bar must comply with health rules, judge rules

Rocking R Bar must comply with Gallatin County health orders and close by 10 p.m., a restriction meant to slow the spread of the virus, a judge ruled on Wednesday. Gallatin County District Court Judge Rienne McElyea granted the countyâs request for a preliminary injunction against the bar, ordering it to comply with the health rule until March. The Gallatin City-County Board of Health and health officer Matt Kelley sued Rocking R Bar after it remained open past 10 p.m. on several occasions, despite a warning that it was in violation of the health rules. Rocking R Bar argued that the closing time was arbitrary and pushes people out to private residences, where health officials arenât enforcing the rules.

Judge rules against Rocking R Bar in suit brought by Gallatin County Rocking R Bar must adhere to 10 PM curfew, judge rules and last updated 2020-12-17 08:35:26-05 BOZEMAN â (Updated 11:50 a.m. MDT, 12/16/2020) UPDATE: Gallatin County District Court Judge Rienne McElyea ruled on Wednesday against the Rocking R Bar, the defendant in a suit brought by the Gallatin County Attorney s Office and the Gallatin City-County Health Department. The ruling means the Rocking R Bar must follow a county ordinance requiring it to close at 10 p.m. The preliminary injunction granted by the judge will be in effect until March. The Rocking R Bar could face further legal action if it continues to disregard the 10 p.m. curfew.
