Real estate agents love it when loan officers give them referrals. That’s not always easy. Is giving a real estate agent a book on becoming a productive and well-respected real estate agent a RESPA violation? How about an all-expense paid trip? Attorney Brian Levy points out in his latest Mortgage Musings (chock full of Rolling Stone song references) how it matters whether the “thing of value” is offered in return for referrals or is just ordinary business promotional activity. LOs know that working with real estate agents is a numbers game. (How many loan officers contact the listing agent when a property goes on the market to ask for a referral?) Did you know that on any given day there are about 61,000 people in airplanes above the United States? (I think that number is light.) I mention this because Heathrow Airport in London is taking the unconventional step of capping the daily number of passengers at 100,000 per day for the rest of the summer. Heathrow was h

This morning I head off to Orange County to the IMN Non-QM Forum where homeownership and home finance option discussions will be center stage. Did you know that June is “Homeownership Month”? Ginger B. reminds us that, the average homeowner will move up to 12 times in their life and on average will own 3 homes in their life, and the median distance between the homes people purchased and those they moved from is just 15 miles. Create a customer for life with your service! Affordable housing fans should know that Habitat for Humanity and Wells Fargo recently partnered on building 350 affordable homes. Certainly, housing is a complicated issue, whether your involve non-profits, public and private corporations, and the U.S. Government. Attorney Brian Levy, in his most recent Mortgage Musings, questions the effectiveness of the federal government’s housing policies. At the city-level, in the last few months I’ve spent a fair amount of time in New York City. Affor

I received this from a loan officer in Michigan. “Forget the Serenity Prayer! Grant me coffee to change the things I can, and wine to accept those that I cannot.” There are tens of thousands of loan originators around the United States, primarily changing things for the better for their clients but recently some of them were caught taking a fraudulent continuing education class. Unrelatedly, one (former) Ohio Mayor claimed that ice fishing can lead to prostitution. Attorney Brian Levy somehow brings it all together in his Mortgage Musings about the slippery slope and what might happen to those LOs when they return from their 90-day suspensions. Fraud, including kickbacks, unfortunately, is on its way higher according to off-the-record chats with LOs, sometimes making the headlines (for example, a Georgia real estate agent ran afoul of the Department of Justice in committing mortgage fraud). And a quick note before we jump into the commentary: yesterday I published news ab

Queen Elizabeth’s husband Prince Phillip has passed away this morning at age 99. Wealthy people in New Yorkseem to be fleeing to live in other states with a lower tax rate. Both Freddie Mac and Fannie Mae released QM loan information that maps out their policies. Any lender originating Agency loans should be aware of their requirements and their effective dates related to their purchase of loans subject to the Qualified Mortgage (QM) Rule and originated relying on the GSE Patch. And tongues are wagging about the proposed CFPB RESPA Servicing Rule with protections for borrowers affected by the COVID emergency. Industry players are questioning the regulatory authority to issue a blanket prohibition on foreclosure through the end of the year and are concerned that the contractual disruption for investors might lead to l
