Stormwater Enforcement: Mississippi Commission on Environmental Quality and Tishomingo County Airport (Belmont) Enter into Agreed Order | Mitchell, Williams, Selig, Gates & Woodyard, P L L C

The Mississippi Commission on Environmental Quality (“MCEQ”) and Tishomingo County Airport (Belmont) (“Airport”) entered into a May 18th Agreed Order (“AO”) addressing an alleged violation of the Mississippi Code related to discharges of waste into waters of the state. See Order No. 7122 21. The alleged violation involved expiration of a general stormwater permit. The AO states that MCEQ on December 12, 2019, conducted a Compliance Evaluation Inspection (“CEI”) at the Airport which is located in Belmont, Mississippi. The AO cites the following alleged violation: A.  Violation of MS. Code Ann. § 49-17-29(2b): which states in part that . . . it is unlawful for any person to carry on any of the following activities, unless that person holds a current permit for that activity from the Permit Board as may be required for the disposal of all wastes which are or may be discharged into the waters of the state. . . The Mississippi Commission on Environmental Quality (“MCEQ”) and Gene Stock Construction (“GSC”) are stated to have entered into an April 6th Agreed Order (“AO”) relating to a failure to obtain a permit for discharge of waste into the water of the state. See Order No. 7106 21. The AO provides that GSC has a “Vacant Land Project” (“VLP”) in Gulfport, Mississippi. GSC is stated to have failed to obtain coverage under Mississippi’s Large Construction Storm Water General Permit before its commencement of construction activities at the site. The AO provides that on November 30, 2020, MCEQ’s Environmental Permits Division received a Large Construction Notice of Intent for coverage under the Large Construction General Permit from GSC for the VLP. The Notice of Intent is stated to be under review.

The Mississippi Commission on Environmental Quality (“MCEQ”) and Pine Bluff Investments, LLC (“PBI”) entered into a March 26th Agreed Order (“AO”) addressing alleged violations of a stormwater general permit. See Order No. 7105 21. The AO indicates that PBI is involved in a development titled Wellington Place (“Development”) located in Oxford, Mississippi. The Development is apparently subject to a MCEQ Large Construction Stormwater General Permit. See MSR1074 (“Permit”). The AO cites the following alleged violations at the Development: Violation of ACT3 Condition S-6 -Failure to submit Major Modification Form. Violation of ACTS Condition T-4 (1) -Failure to implement soil stabilization. Violation of ACT6 Condition S-3 (11)-Failure to maintain storm water controls.
