Für eine solche Einschränkung der Freiheitsrechte hätte es der Verhängung des Ausnahmezustands bedurft, heißt es in spanischen Medien aus dem Gerichtshof. Die Regierung hatte während der ersten Welle der Pandemie nur den Alarmzustand ausgerufen, das Parlament stimmte dem später zu. Nach Ansicht des Verfassungsgerichts war das aber eine unzureichende Rechtsgrundlage für die Ausgangssperre.
