A division bench of Justices RD Dhanuka and Milind Sathaye refused to vacate the stay granted on the divorce decree passed by the Family Court in 2019.
The court quashed FIR observing that the investigating officer failed to establish the identity properly while arraigning him as an accused in the case.
If anybody is booked for criminal offences such as those as have been registered against the petitioner, it may amount to an invasion upon the rights of the citizens of this country, the court said
