and martin martinez s own mother. at a news conference police revealed this isn t the first time martin martinez has been thesent of a murder investigation the subject of a murder investigation. martin martinez was listed as a potential suspect in a crime involving the death of a two-year-old. reporter: that toddler was under martin martinez s care at the time of the death. police got a report last thursday, two days before the murders in modesto. it confirms the death was a homicide but police had not notified martin martinez of the mindings yet. when asked why he was not arrested then police replied when it comes to homicide investigations you only have one shot to make the case. there is more than just the police department involved. we put together a case, there has to be probable dues arrest that individual and enough for the district attorney to file charges on the case. so no, the police department did not drop the ball. it is horrible this happened. there ar
