PIPELINE SECURITY PROGRAM: House Homeland Security Committee ranking member John Katko
In a letter provided to The Hill and sent to acting Cybersecurity and Infrastructure Security Agency (CISA) Director Brandon Wales, Katko raised questions around the agency’s Pipeline Cybersecurity Initiative and assessments conducted on pipeline assets as part of the program.

“In the wake of the Colonial Pipeline ransomware incident, ensuring the success, growth, and effectiveness of the Pipeline Cybersecurity Initiative is more important than ever before,” Katko wrote.
The Pipeline Cybersecurity Initiative was founded in 2018 and involves CISA working with the Transportation Security Administration, the Department of Energy and critical infrastructure stakeholders to assess and secure U.S. pipeline systems.

Texas AG Dodges Twitter Suit Over Moderation Practices
Law360 (May 11, 2021, 11:34 PM EDT) A California federal judge on Tuesday granted Texas Attorney General Ken Paxton s bid to ax a suit Twitter lobbed against him over his investigation of the social media platform s content moderation practices, finding the case to be premature since no enforcement actions have been taken.
U.S. District Judge Maxine Chesney ruled in a seven-page order that Twitter s suit is untimely since Paxton has yet to enforce the civil investigative demand, or CID, seeking confidential information. The CID was issued just days Twitter permanently booted former President Donald Trump for violating the company s policy against glorifying violence.
Twitter responded March 8 with a federal lawsuit alleging Paxton is seeking to punish it for taking Trump s account offline a decision the social media company says is protected free speech.
In her Tuesday ruling, Senior U.S. District Judge Maxine Chesney of San Francisco ruled that Paxton s administrative summonses were not self-executing, meaning that Twitter was not bound to comply with them absent a court order.
In her seven-page opinion, Chesney noted that Paxton had taken no court action to enforce his summonses and that Twitter was not bound to comply with them without court action. So, she dismissed Twitter s suit, noting that its request for an injunction or court declaration against Paxton was premature.
