PHILADELPHIA – A diverted federal discrimination case brought by two retired National Football League players against the organization – claiming that it manipulated cognitive function data to make it less likely Black players would receive proceeds from the 2016 concussion settlement – will now be heard before the U.S. Court of Appeals for the Third Circuit.
Kevin Henry and Najeh Davenport first filed suit in the U.S. District Court for the Eastern District of Pennsylvania on Aug. 20 versus the NFL, of New York, N.Y.
Henry, who played eight years for the Pittsburgh Steelers, and Davenport, who played seven years for the Green Bay Packers, Pittsburgh Steelers and Indianapolis Colts claimed that the NFL violated federal law in handling claims under the concussion settlement, by using different sets of cognitive function data for Black and White players.

RICHMOND â Abril Garcia has spent the pandemic cycling in and out of hospitals, sitting in waiting rooms a few feet from people being tested for coronavirus. Garcia, a 28-year-old medical interpreter, never finds out if a result came back positive.
She only knows not taking the chances of getting sick means Spanish-speaking patients coming in for an ultrasound or mammogram run the risk of misunderstanding their doctorâs words.
With restrictive visitor policies, Garcia became one of their only advocates in a state where 464,606 Virginians are not English proficient. The U.S. Census Bureau estimates more than half are Hispanic, a population facing rampant misinformation and double the case rate of white residents.

Arlington County officials say names of people pre-registered to receive a coronavirus vaccine are still migrating into the state’s new Vaccinate Virginia system.
It has been more than one week since Arlington County shut down its pre-registration platform to send 41,000 names to the Virginia Department of Health’s new statewide platform. The delay means that for now, some pre-registered individuals may not see their registration status. But that does not mean the pre-registrations have gone missing, county spokeswoman Cara O’Donnell said in an email.
“At no time were any lists ‘lost, ” O’Donnell said. “All data still exists, and the County is in the process of rolling out vaccine scheduling notification to residents 65+.”
